Alcohol Public Space Protection Orders

A change in the law means that an area previously classed as a 'Designated Public Space' will now be protected by a 'Public Space Protection Order (PSPO).

There are a number of areas in Milton Keynes that are subject to an Alcohol - Public Space Protection Order (PSPO) and regulations are in place to restrict alcohol consumption in those areas with the aim to reduce or deter anti-social behaviour.

Section 63 of the Anti-social Behaviour, Crime and Policing Act 2014 states that:

  • It is an offence to consume alcohol in this area when ordered not to do so by a Police Officer or other Authorised Officer.
  • It is an offence to refuse to surrender alcohol or a container for alcohol in this area when ordered to do so by a Police Officer or other Authorised Officer

Offenders may be issued with a £100 Fixed Penalty Notice or prosecution resulting in a maximum fine of £500 for either of these breaches of the PSPO.

  • Kents Hill, Monkston Park and Brinklow Parish
  • Newport Pagnell Parish
  • Olney Parish
  • Shenley Brook End and Tattenhoe Parish
  • Stony Stratford Parish
  • Bletchley and Fenny Stratford
  • West Bletchley
  • Wolverton and Greenleys Parish
  • Bradwell Parish
  • Stantonbury Parish
  • Woughton Parish
  • Old Woughton Parish

Fixed Penalty Notices

A constable or authorised person may issue a fixed penalty notice (FPN) of £100 to any person they have reason to believe committed an offence under this PSPO.

To pay a fixed penalty notice (FPN) by a credit or debit card, please contact Milton Keynes Council on 01908 691 691. We will require your FPN reference number and the date it was issued to be able to process the payment.  The FPN will be discounted to £75.00 within 14 days of the date that the FPN was issued.

  • to pay by post  - your cheque or crossed postal order must be made payable to Milton Keynes Council and sent with the fixed penalty notice to:

Receipts will not be issued unless specifically requested.

Appeals 

There is no statutory process of appeal for an offence covered by this FPN. This notice offers you the opportunity of discharging any liability to conviction for the offence.

However, an informal written appeal will be considered provided it is made within 14 days from the date of issue of this Fixed Penalty Notice.

If no payment is made by the end of the 21‐day period, Milton Keynes Council may commence criminal proceedings against you. No reminders for payment will be sent to you.
