Milton Keynes Draft Planning Obligations Supplementary Planning Document 2019

Summary

Milton Keynes Council is consulting on a Draft Planning Obligations Supplementary Planning Document (SPD).

Planning Obligations (sometimes referred to as S106 contributions) are usually made under Section 106 (s106) of the Town Country Planning Act 1990 (as amended). They are a mechanism by which measures are secured to make development acceptable, which would otherwise be unacceptable in planning terms. Planning Obligations need not be entered into by agreement; planning obligations can also be secured by developers entering into a unilateral undertaking.

The Council is reviewing and consolidating its guidance on planning obligations to reflect new national and local planning policy including in light of the adoption of Plan:MK in March 2019. Other reasons for revising this SPD are that existing Council documents to secure planning obligations are somewhat dated. 

The consultation runs for eight weeks, beginning on 8 May and closing on 3 July at 5pm. Further information regarding the consultation is available via the Council’s Planning Obligations SPD webpage.

Purpose

To set out the Council’s policy for securing Planning Obligations from new developments that require planning permission.
