National Planning Policy Framework
The National Planning Policy Framework (NPPF) was published on 27 March 2012. The government considers the NPPF to be a key part of its reforms to "make the planning system less complex and more accessible, to protect the environment and to promote sustainable growth".
The NPPF replaces all of the Planning Policy Statements, Planning Policy Guidance notes and the Minerals Planning Guidance notes that previously formed national planning policy. However, guidance documents that accompanied these policy documents remain in place until such time as they are reviewed or updated. A Technical Guidance Document has been published alongside the NPPF. The Department for Communities and Local Government website states:
"This document provides additional guidance to local planning authorities to ensure the effective implementation of the planning policy set out in the National Planning Policy Framework on development in areas at risk of flooding and in relation to mineral extraction.
This guidance retains key elements of Planning Policy Statement 25 and of the existing Minerals Policy Statements and Minerals Planning Guidance Notes which are considered necessary and helpful in relation to these policy areas. The retention of this guidance is an interim measure pending a wider review of guidance to support planning policy."
Conformity of Milton Keynes Local Plan Policies with the NPPF
Since the publication of the National Planning Policy Framework (NPPF) in March 2012, the policies contained within have become material considerations which local planning authorities should take into account both for the purposes of decision-taking and in the preparation of plans.
Whilst Milton Keynes has an up-to-date Core Strategy, adopted in August 2013, which conforms with the NPPF, the large majority of its Development Management policies are contained within the Milton Keynes Local Plan (2005), which was adopted under the Town and Country Planning Act 1990.
In accordance with paragraph 215 of the NPPF, "due weight should be given to relevant policies in existing plans according to their degree of consistency with this framework (the NPPF) (the closer the policies in the plan to the policies in the framework, the greater the weight that may be given)".
Milton Keynes Council have produced an assessment of all relevant Local Plan (2005) policies against the NPPF, outlining where they conform and conflict with the framework. The assessment then provides a conclusion for each policy summarising the weight that they should be given in-line with their degree of consistency with the NPPF.
