Confirmation of Article 4 Direction in the Central Business District area of Central Milton Keynes - March 2022

Introduction

At a delegated decision meeting on the 22 March 2022, Milton Keynes Council resolved to confirm the Article 4 Direction in the Central Business District of Central Milton Keynes made by the Council on 7 October 2021.  The above Article 4 Direction has been confirmed by the Council and will come into force on the 8 October 2022.

In an email dated 6 May 2022 the Council was informed that the Housing and Planning Minister, on behalf of the Secretary of State, has considered the evidence provided by Milton Keynes for the Article 4 direction removing permitted development rights allowing the conversion of offices (Class E(g)(i)) to residential use in the Milton Keynes Central Business District, which was made on 7 October 2021, and came  into force on 8 October 2022.

The Housing and Planning Minister was satisfied that the Article 4 direction is justified to avoid wholly unacceptable adverse impacts of the permitted development rights on the vitality and viability of the office provision in the Milton Keynes Central Business District, and that the Article 4 direction has been targeted to apply to the smallest geographical area possible (the essential core of Milton Keynes) and to offices rather than the whole of Class E. The Article 4 direction is therefore considered to comply with national policy.

What Does an Article 4 Direction do?

The Direction removes permitted development rights within the Central Business District area of Central Milton Keynes for the change of use of a building and any land within its curtilage from a use falling within Class E(g)(i) (offices) of Part A, Schedule 2 to the Town and Country Planning (Use Classes) Order 1987 (“the Use Classes Order”), to a use falling within Class C3 (dwellinghouses) of Part C, Schedule 1 to the Use Classes Order. It removes permitted development rights under Class MA Part 3 to Schedule 2 of the Order. Once the Direction is in force within the area covered by it, anyone proposing to change an office to residential use will be required to apply for planning permission to the Council.

What area does the Article 4 Direction cover?

The area covered by the Direction is the Central Business District of Central Milton Keynes. This is the area between V7 Saxon Street, H6 Childs Way, the West Coast Mainline and H5 Portway and is shown edged red on the Map attached to the Order.

Consultation on Article 4 Direction within the Central Business District of Central Milton Keynes - October 2021

Introduction

At a delegated decision meeting on the 21 September 2021, Milton Keynes Council resolved to make and consult on a new Article 4 Direction within the Central Business District of Central Milton Keynes.

The Direction was made on 7 October 2021 and if confirmed, it will come into force on 8 October 2022 and will replace the current Article 4 Direction within the Central Business District which expires on 31 July 2022.

What does the Article 4 Direction do?

The Direction removes permitted development rights within the Central Business District area of Central Milton Keynes for a change of use from an office, Class E(g)(i) (offices) of Part A, Schedule 2 to the Town and Country Planning (Use Classes) Order 1987 ("the Use Classes Order"), to a use falling within Class C3 (dwellinghouses) of Part C, Schedule 1 to the Use Classes Order. At a delegated decision meeting on the 10 November 2020, Milton Keynes Council resolved to confirm the Article 4 Direction in the Central Business District of Central Milton Keynes.  Milton Keynes Council has confirmed the Article 4 Direction on 25 May 2021 and it will come into effect on the 2 July 2021.

What does the Article 4 Direction do?

The Direction removes permitted development rights within the Central Business District area of Central Milton Keynes for a change of use from an office, Class B1a (offices) of the schedule to the Town and Country Planning (Use Classes) Order 1987 ("the Use Classes Order"), to a use falling within Class C3 (dwellinghouses) of the Use Classes Order.  Once the Direction is in force within the area covered by it, anyone proposing to change an office to residential use will be required to apply for planning permission to the Council.
