Trading Standards privacy notice

Milton Keynes Trading Standards service forms part of Milton Keynes Council.  This privacy notice sets out how we deal with your personal information within this Service.  It links in with the council’s corporate privacy notice so should be read alongside it. Milton Keynes Trading Standards service collects information about you in order to provide the residents and businesses of Milton Keynes with a trading standards service.

This is done as we have a statutory or legal obligation to do so. This comes from numerous laws including (but not limited to)

  • Consumer Rights Act,
  • Consumer Protection from Unfair Trading Regulations,
  • Consumer Protection Act and
  • Criminal Procedure and Investigations Act (CPIA). 

The information that is collected by this service will come from many sources such as

  • members of the public,
  • businesses,
  • Citizens Advice Consumer Helpline,
  • other departments within Milton Keynes Council,
  • other local authorities,
  • Police,
  • other law enforcers and
  • Central Government departments.

What is our legal basis for using this information?

The use of this information will be dependent upon the purposes for which it was provided. See the lists below.

The primary legal basis will be either;

  1. Prevention, investigation, detection or prosecution of criminal offences. The execution of criminal penalties including the safeguarding against and the prevention of threats to public security. These matters will be referred to as  “law enforcement purposes”
  2. Performance of a task carried out in the public interest or official function
  3. Processing is necessary for compliance with a legal obligation to which Milton Keynes council is subject, or
  4. Consent given by the individual to our use of the data, for the specific purposes of processing

All of the personal information we hold is kept securely on our Council servers/held externally within the UK/EU. There is also no automatic decision taking when your personal information is processed.

How do we use this information?

We will use the information for the purposes for which it was provided and this could include;

  • To carry out our statutory duties under relevant legislation which may include inspection, testing and sampling (“law enforcement purposes”)
  • To carry out investigations of alleged criminal offences contrary to the legislation we enforce (“law enforcement purposes”)
  • To carry out investigations into alleged breaches of civil law that we enforce  (“law enforcement purposes”)
  • To provide advice and chargeable advice to businesses to assist them in compliance with legislation that we enforce
  • To administer our Buy With Confidence approved trader scheme
  • To provide safeguarding support to vulnerable adults at risk of financial abuse

How long do we hold your information and what rights do you have?

We will retain your information securely for 6 years, plus the current year in which data processing is completed.
