Planning Obligations for Home Buyers and Solicitors
When purchasing a home on a development that is subject to a Section 106 agreement, buyers often ask whether they are personally responsible for any obligations.
The council does not act against individual homeowners* for unmet planning obligations.
S106 obligations are a land charge, but responsibility for fulfilling them remains with the developer or relevant landowner identified in the agreement—not with individual residents.
Local authority searches will show whether a property is affected by a Section 106 agreement, but this does not mean the homeowner is liable for any outstanding obligations.
Solicitors can download a letter from the planning obligations team confirming the information provided above.
If a detailed compliance confirmation for all S106 obligations contained within a specific S106 agreement is required, then it can be provided for an administration fee of £175 per agreement (remittance slips for proof of payment will be required).
