Make an Appeal

Who can appeal?

Only the applicant can make an appeal against refused planning permission or imposed conditions. Neighbours and other third parties have no right of appeal.

Before making an appeal

You will find reasons for refused planning permission in the decision notice. Often, you can work with your planning officer to resolve these issues.

Consider resubmitting your planning application instead of appealing. This can be quicker and, if done within one year, will not normally attract a fee.

Reasons for appeal

There are four reasons for appeal:

1. Milton Keynes Council

  • refused permission
  • gave permission with conditions you consider inappropriate
  • refused the details of a scheme that they, or the Secretary of State, had already given outline permission for
  • approved the details of a scheme with conditions you consider inappropriate or unreasonable

2. Milton Keynes Council rejected a proposal arising from a condition or limitation on a planning permission

3. Milton Keynes Council did not decide within the time allowed

4. Milton Keynes Council required more information before issuing a decision about your outline application and you do not wish to supply this

Time limit

Householder appeals: 12 weeks of the decision notice.

Other appeals: Six months from the date refusal was issued, or when the council should have determined the planning application.

How to make an appeal

To appeal, you must be the person who submitted the initial planning application.

Completing the form

You must complete three copies of the appeal form - one each for

  • the Inspectorate
  • Milton Keynes Council
  • your records

You must detail your grounds for appeal and reasons why including any additional information you would like the Inspectorate to consider.

Ensure that your appeal includes

  • the correct certificate of land ownership
  • a copy of your planning application
  • a copy of the certificate of land ownership (sent with the original application)
  • a list and copies of all relevant documents, drawings and plans that were part of the original application and any subsequent amendments or additional information submitted (including an environmental statement, if one was included or requested by the council)
  • copies of all relevant letters (including letters or drawings sent to the council amending the application)
  • a copy of the decision notice (if applicable)
  • a copy of any decision that the application had to be dealt with under the Environmental Impact Assessment Regulation 1999
  • If you want approval of reserved matters: a copy of the original application for outline planning permission, the plan and the outline permission itself

Process

Ensure that you keep to the strict deadlines - any information submitted outside of the deadlines will not normally be considered.

There are three different procedures

  1. written representations (this is the most common method)
  2. hearings
  3. inquiries

Once your appeal has been received and accepted, a start date will be issued. Milton Keynes Council will send you and the Inspectorate a questionnaire and notify interested parties within two weeks of this date.

Both you and Milton Keynes Council can submit a statement of case, within six weeks of the start date - where Milton Keynes Council can comment on your appeal.
