Charging orders and bankruptcy

Charging order 

If a Liability Order has been granted, you owe more than £1,000 in Council Tax under one or more Liability Orders, and you have a legal interest in a property, the Council may apply to the County Court for a Charging Order.

A Charging Order secures the debt against your interest in the property. If the property is sold, the outstanding Council Tax debt secured by the Charging Order may be paid from the sale proceeds.

Bankruptcy 

If a Liability Order has been granted and your total Council Tax debt exceeds £1,500, the Council may begin bankruptcy proceedings against you.

If a Bankruptcy Order is made, control of your financial affairs will pass to a Trustee, who will manage your estate and assets. These assets may include:

  • Any interest you have in a property
  • Pension arrangements (subject to relevant legislation)
  • Endowment policies
  • Savings and investment plans

Bankruptcy can have serious financial consequences and may affect your ability to obtain credit in the future.

The costs associated with bankruptcy proceedings and the administration of your estate can be substantial, often amounting to several thousand pounds. These costs are usually recovered from your assets before any remaining funds are returned to you.

A Bankruptcy Order can be made even if you do not respond to or engage with the proceedings. It is therefore important that you do not ignore any correspondence relating to bankruptcy and that you seek advice as soon as possible.
