If Council Tax remains unpaid after a Liability Order has been granted, we may pass your account to enforcement agents (previously known as bailiffs).

Enforcement agents are authorised to recover unpaid Council Tax debts. They may take control of goods and, where necessary, remove and sell them to recover the amount owed.

Additional fees are added when an account is referred to enforcement agents, so it is important to contact them as soon as possible.

If you have been contacted by one of our enforcement agents, you should contact them immediately to discuss your account and make payment.

In some cases, they may be able to agree a payment arrangement to help you clear the debt over time.

If your account has been passed to an enforcement agent, you must deal with them directly.

Once a Liability Order has been granted and the debt has been referred for enforcement, we can only withdraw the case if:

  • the debt was referred in error, or
  • you are able to pay the full outstanding balance, including enforcement fees

Enforcement agents are acting on our behalf and are legally authorised to collect the debt.

If you do not engage with them, further fees may be added and additional recovery action may be taken.

If you believe enforcement action has been taken incorrectly, contact us and provide evidence so we can review your case.

All enforcement agents working on our behalf have specialist welfare teams that can consider individual circumstances and provide additional support where appropriate.

If you are experiencing financial difficulties or have circumstances that may make you vulnerable, you should tell the enforcement agent as soon as possible.

If the enforcement agent cannot collect the Council Tax, the debt will be returned to us to consider other recovery options. These may include bankruptcy, committal to prison or a charging order against your property. 

Yes. Enforcement agents in England and Wales are authorised under the Tribunals, Courts and Enforcement Act 2007 and the Taking Control of Goods Regulations 2013 to take control of goods and recover unpaid debts.

The following statutory fees apply when an account is referred to enforcement agents:

Compliance Stage – £79: This fee is added when the account is first passed to the enforcement agents to collect an unpaid debt. 

Enforcement Stage – £247: This fee is added when an enforcement agent visits your property for the first time.  

Sale/Disposal Stage – £116: This fee is added if the enforcement agent takes further action to remove goods for sale.

An additional fee of 7.5% will be charged on any debt balance over £1,900.
